TERMS AND CONDITIONS
i - Terms used in this agreement
"Khyle.org.uk", "webmaster" and "Khyle Westmoreland" all pertain to Khyle
Westmoreland, the owner of the server the domain http://www.khyle.org.uk is
pointing at.
1 - General setup
1.1
Khyle.org.uk offers advertisement-free, no-cost web hosting to friends and family should they wish
to have pages on the Internet. Anyone wishing to claim this should contact Khyle
Westmoreland - webmaster[at] khyle.org.uk with a reason to use our server space
for your website. If
your request is granted you will be given a URL of your choice (in the format
http://www.khyle.org.uk/chosensubdirectory) and FTP access for uploading your
HTML files.
1.2
Forwarding domain names to your subdirectory is allowed, and if
requested you may point your ANAME records to the server in order to disguise
Khyle.org.uk. Please note if you do choose to forward your ANAME records and the
server's IP address changes you will be notified but it will be your
responsibility to update the records.
2 - Server storage
2.1
Currently there is no limit to the amount of space or bandwidth your website
can take up although if it gets excessive Khyle.org.uk's webmaster will review
the situation and work towards a resolution which all parties are happy with. If
bandwidth and/or disk usage get too high and no resolution is agreed upon,
Khyle.org.uk's webmaster reserves the right to delete any files deemed necessary
to retain optimal operation of the server.
3 - Legal responsibilities
Khyle.org.uk takes absolutely no responsibility for pages stored on this server.
3.1
If there are any complaints received about content on the website and the
webmaster agrees with this it will be moved to a non-publicly accessible folder
until a resolution is reached. If no resolution is reached it will be taken
offline indefinitely. The legal complaints address is abuse [at] khyle.org.uk
. All claims sent to that address will be looked at in detail and both
the website owner and the party who sent the complaint will be aware of the
outcome.
3.2
Khyle.org.uk reserves the right to modify any material stored on the server at
any time without prior consultation or notice should it be felt necessary. This
includes any applicable "dissing of Khyle or any of the stuff he does".
3.3
Khyle.org.uk makes every effort to back up data on a regular basis but is in
no way responsible for any data lost. The webmaster encourages you to make your
own regular backups and therefore in the event of a data loss whether partial or
complete you are able to re-upload all your data.
4 - Downtime
4.1
As this service is provided without charge to friends and family,
Khyle.org.uk is not able to offer any compensation as a result of data loss or
website unavailability. Should Khyle.org.uk experience downtime without any
prior warning we will try to bring all services online as soon as possible. If
we contact you regarding downtime of more than 15 minutes we will do so at least
24 hours in advance. For downtime less than that amount we do not believe it is
worth contacting you. Should planned downtime of less than 15 minutes go over
that allotted time we will make every attempt to bring the services back online
but cannot make any promises. Any downtime suffered as a result of my ISP
(ntl:world), which is out of my control, is not our fault and it is the problem
of the ISP to fix any problems.
5 - Services
5.1
Khyle.org.uk offers free use of PHP on the server by using file types of
.php. Use of PHP is not restricted but if found to be draining server resources
(either RAM or CPU time) it will be reviewed and if necessary, access to PHP
will be denied. The webmaster will be somewhat lenient on this matter as many
people may rely on the use of the PHP processing for their website to function.
Use of CGI (Perl) and MySQL are available on request. Access to these will be
granted on request, and any appropriate usernames/passwords or setup will be
provided along with details on how to access it.
5.2
Uploading your files will be available via FTP. A username and password will
be given to you. Either of these values can be changed upon request and for
security reasons they may be changed by the webmaster from time to time. If
these details are changing you will be notified immediately after they have been
changed. Khyle.org.uk provides this FTP access along with access to HTTP. Apart
from the use of PHP/Perl/MySQL these are the only services available. We do not
allow access to any other services such as mail or telnet, despite these
services being run on the server. Attempts to access these, which are for the
personal use of the webmaster only will result in your account being suspended
or terminated.
6 - Terms and Conditions
These Terms and Conditions are subject to change without warning at any time.
If they do change it is your responsibility to make sure any subsequent changes
do not apply to you. The webmaster of Khyle.org.uk will try to be lenient when
applying these terms and conditions and should they be breached a resolution
will be worked toward before any action is taken. This is true in all cases
except complaints, where Khyle.org.uk must agree with a complaint before it is
taken offline immediately. If there is a good reason for it to remain on the
Internet you must have a disclaimer explaining there is offensive content before
any user enters the page with an option for the user to exist if they do not
wish to see it.
If you do not agree to any of the above please make it known as soon as possible. If you are found to be breaching any of the above we will "come down on you like a ton of bricks".
